New European Commission Proposal to Postpone CLP Labelling Deadlines in Regulation (EU) 2024/2865

Context and reasons for the amendment

Regulation (EU) 2024/2865, already analysed in our previous blog, introduces changes to Regulation (EC) No 1272/2008 (CLP).

It established new rules for the labelling of hazardous substances and mixtures, including:

  • Specific label formats.

  • Deadlines for relabelling.

  • Requirements for advertising and distance selling.

  • Labelling requirements for fuels at service stations.

However, the increased complexity and volume of requirements have raised concerns among companies regarding administrative burden and associated costs.

For this reason, the European Commission has proposed simplifications and decided to postpone the entry into force of the more complex rules to facilitate the transition.

Objectives of this proposal

The main objectives of the proposal are:

  • Reduce the administrative burden and costs that the new labelling requirements impose on companies, especially SMEs.

  • Extend adaptation periods and avoid the confusion caused by the current application dates.

  • Provide flexibility for the aspects that present the greatest compliance difficulties and that do not offer significant benefits for the protection of human health and the environment.

With this proposal, the CLP Regulation labelling deadlines are postponed and adjusted to coincide with the amendments to Regulations (EU) 2019/1009 on fertilising products and (EC) No 1223/2009 on cosmetic products.

This provides regulatory coherence and simplifies procedures through aligned timelines.

Main changes to the application dates

The amendment modifies Article 2 of Regulation (EU) 2024/2865 as follows:

  • The following provisions are removed from the list scheduled to enter into force on 1 July 2026:

    • Amendments to Article 30 (relabelling deadlines).

    • Article 48 (advertising).

    • Article 48a (distance selling).

    • Provisions on fuel dispenser labelling in Annex II.

  • The following provisions are removed from the list scheduled to enter into force on 1 January 2027:

    • Amendments to Article 31(3).

    • Relevant sections of Annex I regarding mandatory format requirements.

  • A new paragraph 3a is added to Article 2, establishing 1 January 2028 as the new application date for all previously mentioned provisions.

As a consequence, the provisions affected by this extension are removed from the section that allows voluntary application of Regulation (EU) 2024/2865 before its application date (paragraphs 4 and 5 of Article 2) and moved to a new paragraph 5a, aligning the dates.
