WHAT ARE THE TOXICOLOGICAL DATA SHEETS?
It is the means to transmit the information required and in the format established by the National Institute of Toxicology and Forensic Sciences (INTCF). Toxicological records include data such as trade name, classification, quantitative composition, label, SDS, etc.
AM I REQUIRED TO NOTIFY THE TOXICOLOGICAL CHIPS? WHEN?
In Spain, from the moment I apply the CLP regulation, I am obliged to notify the toxicological files to the INTCF, even though I am doing it before the deadline of June 01, 2015.
DOES THE NOTIFICATION OF TOXICOLOGICAL CHIPS IN SPAIN TO THE INTCF IS ALREADY VALID FOR ALL THE COUNTRIES OF THE EU?
No. There is a European unification project but it is not yet defined. At the moment, each member state will apply article 45 of the CLP independently. In Spain, the notification procedure is regulated by Order JUS / 836/2013.
WHAT PRODUCTS ARE EXCLUDED FROM THE PROCEDURE FOR NOTIFICATION AND DEVELOPMENT OF TOXICOLOGICAL INFORMATION?
Those that are exempted by Article 1 of the CLP Regulation and those that are excluded by Article 45:
- Non-commercial mixes (samples, tests, intermediate products, …)
- Commercial mixtures that are only hazardous to the environment or not classified as dangerous.
Article 45
- Member States shall designate the bodies responsible for receiving, from importers and downstream users who market mixtures, relevant information, in particular, for the formulation of preventive and curative measures, in particular for health response in case of emergency. This information shall include the chemical composition of the mixtures placed on the market and classified as dangerous due to their effects on human health or their physical effects, as well as the chemical identity of the substances present in mixtures for which the Agency has accepted an alternative chemical name with according to article 24.

On June 1, 2017, the second term of notification of the toxicological files to the INTCF, corresponding to the mixtures not included in the first notification phase, which had a limit of January 1, 2016, ended.
